Charlotte DePersia to Face Judge Tuesday Morning

East Hampton woman violated her probation for DWI, according to the district attorney's office.

Charlotte DePersia, who is currently serving probation after pleading guilty to , is due in court Tuesday to answer for allegedly drinking alcohol in violation of the terms of her probation.

According to Suffolk County District Attorney Thomas Spota's office, the 59-year-old East Hampton woman was already on probation for a 2009 DWI when she caused a crash in Bridgehampton in November 2010. She struck another vehicle with four occupants, causing a pregnant woman to suffer broken ribs and injuring another woman's face, requiring surgeries.

The women, of New Jersey and East Quogue, and their husbands had urged Judge William Condon to throw DePersia in prison, in light of her previous DWI arrest. But Condon opted for strict probation, including 840 hours of community service, an ankle bracelet that detects alcohol in sweat, ongoing alcohol and narcotic treatment and an ignition interlock device placed on her vehicles.

At , Condon said "I have given her no margin of error" and he told DePersia, "Forget drinking and driving. You can never drink again."

Spota said prosecutors will strongly urge that DePersia be sentenced to prison for the probation violation.

“She has been arrested three times over the past nine years for driving under the influence of alcohol and our stance hasn’t changed," Spota said. "The time has come for Ms. DePersia to spend time in an upstate correctional facility."
