Village Police Log: Felony Cocaine Charges

The following information was supplied by the Southampton Village Police Department. A criminal charge is only an accusation and does not indicate guilt.

 

Southampton Village Police Department arrest reports for Dec. 20 through Jan. 2:

Criminal Possession of a Controlled Substance

• James F. Caine, 24, of Manorville, was arrested Dec. 26 at 9:30 p.m. and charged with criminal possession of a controlled substance in the fifth degree, a felony. Police said they stopped Caine for a vehicle and traffic violation while operating a 2007 Pontiac on North Sea Road and found him to be in possession of more than 500 milligrams of cocaine. In addition, he had two outstanding warrants from the Suffolk County Police Department, police said. He was processed and remanded to the Suffolk County Jail in lieu of $5,000 bail.

• George A. Berkhofer, 35, of Montauk, was arrested Dec. 24 around 10:04 p.m. and charged with three counts of criminal possession of a controlled substance in the seventh degree, a misdemeanor.  Berkhofer was found to be in possession of a quantity of cocaine and prescription pills, Klonopin and Alprazolam, police said. He was processed and released after posting $330 bail.

•  Joseph S. Hoeler, 34, of Sag Harbor, was arrested Jan 2. At 11:18 a.m. and charged with criminal possession of a controlled substance in the seventh degree, a misdemeanor, namely suboxone. In addition, he had an outstanding bench warrant for burglary in the second degree from the Suffolk County Police Department, police said. Hoeler was processed and released to the Suffolk County Police.

DWI

• Olena T. Schwartz, 34, of New York City, was arrested Dec. 21 at 8:30 p.m. and charged with DWI and aggravated unlicensed operation of a motor vehicle in the third degree, both misdemeanors. Police said they came upon Schwartz at the intersection of North Sea Road and West Prospect Street while she was stopped in the middle of the intersection in a 2011 Mercedes Benz impeding the flow of traffic. As an officer approached the vehicle, Schwartz took off at a high rate of speed, police said. She continued weaving in and out of oncoming traffic on North Sea Road until she was stopped on North Sea Road, according to police.  She was taken into custody and charged with DWI.  She was held for morning arraignment.

• Nancy Nieves-Perez, 53, of East Hampton, was arrested Jan. 1 at 2:45 a.m. and charged with DWI, a misdemeanor. Police said they stopped Nieves-Perez while she was driving a 2005 Mazda Tribute eastbound on Hampton Road for crossing over the double yellow line multiple times.  She was arrested, charged and held for morning arraignment.

• Armand J. Scala, 60, of New York City, was arrested Jan 1. at 3:06 a.m. and charged with DWI, a misdemeanor.  Police said they stopped Scala while she was driving a 2003 Honda on County Road 39 for multiple vehicle and traffic violations. He was arrested, charged, and held for morning arraignment.

Social Host Law Violation

• Nancy Silverman, 47, of Southampton, was arrested Jan. 1 at 12:55 a.m. and charged with violating the Suffolk County Social Host Law. Police said they were called to a residence on Wooley Street for a complaint of underage drinking. Upon arrival, officers found multiple underage youths at the residence in possession or consuming alcoholic beverages, police said. Silverman was arrested, processed and released after posting $200 bail. She is scheduled to return to court on Jan. 23.
